Conveyancing is the process of transferring legal ownership of a property’s title from one person to another. Transferring property typically involves complex legal documents and it is important to conduct a thorough review of the contract prior settlement to understand you rights and obligations.

We strongly advise you apply for one as soon as the contract is executed.
Certificates may take up to 28 days to process. Certificates are valid for 12 months.

Searches are a very important part of the conveyancing process. Searches reveal the details of the property, disclose third party interests over the property, debts owing over the property, such as land tax. By carrying out these searches early in the conveyancing process, it allows the Buyer to
make informed decisions about the purchase.
We will provide you with a list of available searches with their costs and advise you which searches we think are particularly relevant to your property. You will then instruct us which searches to order on your behalf.
Property bills will be apportioned at Settlement. You will still be required to pay your share of the bills for the Property up until the Settlement date.
Should you have any bills due before the settlement date and unsure if you need to pay them, please forward a copy to your conveyancer. If you do pay a bill for rates, water, land tax or body corporate, please send us a copy of the receipt. Please also consider cancelling any direct debits you may have in place for these bills.
"Time is of the essence" is a legal term used in conveyancing transactions to indicate that the specified timeframes in a contract are critical and must be strictly adhered to. This means that any deadlines set in the contract, such as the settlement date, are essential terms, and failure to meet these deadlines can result in a breach of contract.
In Queensland, the importance of "time is of the essence" is highlighted in standard contracts like the REIQ Contract for Houses and Residential Land. For example, Clause 6.2 allows either party to extend the settlement date by up to 5 business days, but time remains of the essence even with this extension. This means that if the extended deadline is not met, the other party may have the right to terminate the contract or seek other remedies.
The concept ensures that both parties are committed to completing the transaction within the
agreed timeframe, providing certainty and predictability.
